JEFFERSON COUNTY, AL (WBRC) - It's a victory for Jefferson County election officials and a loss for GOP Jefferson County DA candidate Bill Veitch.

This afternoon, Jefferson County Judge Jim Huey ruled it was too close to the June 6 primary to make changes to the election ballot. Hugely also lifted a temporary restraining order to allow Jefferson County's Probate Judge Office to print the ballots for oversea voters on Saturday.

Veitch filed a lawsuit and received a TRO contending voters in the Bessemer cutoff should vote in the Jefferson County DA and circuit clerk races. The offices are the Birmingham division.

Veitch contended it was wrong to exclude 114,000 voters in the cutoff. Veitch tells WBRC FOX6 News that he will not campaign where he can for votes. Veitch has not consulted with his attorney yet about  a possible appeal.

The following statement was posted on the Campaign to Elect Bill Veitch Facebook page:

"Jefferson County Cut-off Friends: Bill Veitch went to bat for YOU today to preserve YOUR RIGHT TO VOTE! It has always been our stance that EVERY citizen in Jefferson County should have a chance to vote for their Jefferson County District Attorney in the Primary election, but the Judge over our case today decided our case was too close to the election to address the issues presented and dismissed our case. Although our friends in the Cut-off are not assured a vote in my Primary race, rest assured you can vote for me in November! We will push on and make you proud to be a Veitch supporter!"
